will i still be able to play on xbox live without getting banned, with the original ms bios and still download the updates, i have a 1.6, xenium ice chip, 39xx bios, hq-autoinstaller .

Yes, you can play Xbox Live with a mod chip as long as you have the MS bios running. However, keep in mind that if your machine has already been logged into XBL prior to modding then MS has the original HD serial number on record.
If you were to upgrade/change the HD and then login to XBL again with the new equipment, you would get banned even using the MS Bios.
I have never personally known anyone to flash the MS Bios to a mod chip. Ususally you have a way to boot your machine with the hacked bios inactive. Like the Xenium and SmartXX allow you to choose which bios you boot from the OS menu, while other chips require you press a button for a certain amount of time while booting...etc....
