Supposedly the account is still good the box is banned. But I would figure why not just ban the account rather than the xbox, it would be easier. But they are in it for the money, charge you 5.99 a month and make you buy another Xbox (less that an eeprom from someone who bought(has bought) an xbox.
Its a vicious money making circle.
I would guess no, but why not just make another name and they won't have a sheet on you. Unless you still want your old stats for bragging rights.
Some guys have said they are required to pay $90 ban fee to be readministered into the XLive Arena and I would think that to be a charge against the account. _________________ XBOX v1.6

Yes, you need to have a non-modded xbox with original stock HD and use the XBL Recovery Account function.
I have done so because my brother whn started xbox even forget to turn-off the modchip and i was bored to buy new eprom.
