A Detroit judge has denied 80s band The Romantics’ request for Activision to stop using the song “What I Like About You” in Guitar Hero Rocks the 80s.

Activision had permission to use a cover band to make a recording of the song, but The Romantics said that the recording sounded too much like the original and could lead consumers to think that the recording was actually The Romantics.

The Romantics sought a preliminary injunction against the sales of Guitar Hero Rocks the 80s, along with compensatory and punitive damages. With this week's ruling of Judge Nancy G. Edmunds, sales of the game will continue as normal.

“In making the ruling, Judge Edmunds indicated that to the extent there were any copyright issues, Activision did exactly what the company was supposed to do in developing the product,” Activision said in a statement.
